Terms of Service

1. Purpose
These Terms of Service (“Terms”) govern access to and use of the Zigra mobile application (the “App”) and related services (the “Services”), which connect drivers and passengers wishing to share a carpool ride in Madagascar.
By creating an account or using the App, you fully accept these Terms. If you do not agree, you must not use the App.
2. Definitions
- User: any person holding an account on the App.
- Driver: a User offering a ride in their vehicle.
- Passenger: a User booking a seat on an offered ride.
- Ride: a trip published by a Driver between a departure point and a destination.
- Platform: the technical means enabling the Services.
3. Registration and account
Using the Services requires creating an account with a valid phone number. You undertake to provide accurate, complete and up-to-date information and to keep it current.
You are responsible for keeping your credentials confidential and for all activity carried out from your account. Registration is reserved for persons aged 18 or over.
4. Zigra’s role
Zigra is a technical intermediary connecting Drivers and Passengers. Zigra is neither a carrier nor a transport company and is not a party to the carpooling agreement entered into between Users.
Carpooling offered through the App is part of a non-profit cost-sharing framework: the Driver may not make a profit from a ride.
5. User obligations
You undertake to:
- use the App in good faith and in compliance with applicable law in Madagascar;
- provide accurate information about rides, schedules and conditions;
- respect other Users and behave courteously and safely;
- not use the App for fraudulent, illegal or unauthorized commercial purposes.
The Driver warrants in particular that they hold a valid driving licence, a roadworthy vehicle and insurance covering passenger transport.
6. Bookings and payments
Cost sharing may be settled via the integrated mobile payment methods (TelMa Money / MVOLA) or any other accepted means. Amounts, cancellation conditions and any service fees are shown in the App at the time of booking.
7. Cancellation
A User may cancel a booking or a ride under the conditions displayed in the App. Repeated or abusive cancellations may result in access restrictions.
8. Ratings and reviews
After a ride, Users may rate each other. Reviews must be honest and respectful. Zigra reserves the right to remove any inappropriate content.
9. Liability
Zigra cannot be held liable for damages arising directly or indirectly from the performance of a ride, the behaviour of a User, or the inaccuracy of information provided by Users. Users are solely responsible for the rides they undertake.
Zigra uses reasonable means to ensure the availability of the App but does not guarantee uninterrupted or error-free operation.
10. Suspension and termination
Zigra may suspend or delete an account in the event of a breach of these Terms, fraudulent behaviour, or conduct endangering the safety of other Users. You may delete your account at any time (see the Delete account page).
11. Personal data
The processing of your personal data is described in our Privacy Policy.
12. Intellectual property
The App, its brand, logos and content are protected. Any unauthorized reproduction or use is prohibited.
13. Changes to the Terms
Zigra may amend these Terms at any time. Users are informed of material changes. Continued use of the App constitutes acceptance of the updated Terms.
14. Governing law
These Terms are governed by Malagasy law. Any dispute falls under the competent courts of Madagascar.
